The Council is aware that passing a resolution denying consent for WCID No. 3 does not necessarily stop the WCID from forming and the development from moving forward as planned. The developer (BoerneBak, LLC.) has other options to form the WCI...D including going back to the Texas Legislature or going through a process with the Texas Commission on Environmental Quality (TCEQ). While these options may cause delay, the City of Boerne would ultimately have little or no control over how the property is developed. The Boerne City Council chose to table the WCID No. 3 item to allow time for further discussions with the developer on a potential development agreement (DA) to mitigate, to the degree possible, the negative impacts from the development on the Boerne community and to provide the city with some control over certain aspects of the development.
